Justice after 35 years. James Bain
Haste makes waste. We’ve all heard that adage in our lives. Our parents, teachers and other authority figures probably said it at some point. Well for James Bain, 54, haste cost him 35 years of his life.
When Bain was 19 years old he was hastily prosecuted for the rape of a 9 year old boy. The boy hastily picked him out of a photo line-up. The young boy’s father hastily suggested it was Bain who fit the profile his son had supplied. The court system hastily found him guilty and sentenced him to life in prison without much of any evidence.
Patience is a virtue. Another adage we have all been taught. Be patient and good things will come to you. For James Bain patience was all he had. He had no choice but to sit by and wait for the opportunity to prove his innocence.
The truth shall set you free. An upbeat phrase, something to look forward to. For James Bain the truth came about through DNA testing, a tool that he did not have access to during his trial. The testing proved him innocent and he was freed.
No one is perfect. That one is so true. However the imperfection of the victim and his finger pointing, the imperfection of the court system in an obvious attempt to get a case done and over with, the imperfection of the appeals process that waited too long to hear his case when the testing could have exonerated him in 2001.
This is not just a tale of James Bain. Every year detectives and prosecutors rush to find the criminal in cases, not always caring that they find the guilty party as long as they can prosecute someone. Our justice system is the best in the world, but it still has a long way to go. Attorneys on both sides work as hard as they can to win their case and it is very rarely about the truth, but instead about how to make your side look like the truth.
Congratulations James Bain. I pray that your story gives hope to all those others out there who were wrongly convicted.
